Professional discussion on improvement of cases under examination through the procedure of simplified proceedings

Today, a discussion on the draft Law "On making an amendment to the Civil Procedure Code of the Republic of Armenia" was held with the participation of interested parties in Yerevan. The discussion was organised by the "Centre for Legislation Development and Legal Research" Foundation of the Ministry of Justice of the Republic of Armenia, and the draft submitted for discussion was developed through co-operation between the Ministry of Justice of the Republic of Armenia and the Supreme Judicial Council.

Among the participants of the discussion were First Deputy Minister of Justice of the Republic of Armenia Artur Hovhannisyan; member of the Supreme Judicial Council Sergey Meghryan; Director of the Foundation Tigran Markosyan; judges of the Court of Cassation, the Civil Court of Appeal and the first instance courts of general jurisdiction of the city of Yerevan and marzes, as well as representatives from the Ministry of Finance, the Central Bank, the Union of Banks of Armenia, the Staff of the Human Rights Defender of the Republic of Armenia, the Chamber of Advocates, the "Centre for Legislation Development and Legal Research" Foundation of the Ministry of Justice of the Republic of Armenia and civil society representatives.

Director of the Foundation Tigran Markosyan expressed gratitude to the attendees for their participation and noted that, due to a number of problems that have emerged in the law-enforcement practice of simplified proceedings, the Ministry of Justice has decided to develop a new draft. Besides that, according to Tigran Markosyan, the Supreme Judicial Council recently published the concept paper on "Complex Improvement of the Effectiveness of Justice in Armenia" in which, among other things, what is also important is the issue of introducing a toolkit for easing the burden of judges with regard to civil cases. "Taking into account also the need for full exercise of the principle of efficient procedural management, it was decided to develop this draft jointly with the Supreme Judicial Council. The draft is posted on the unified website for publication of draft legal acts (www.e-draft.am) for public consideration,” the Director of the Foundation said and wished everyone a productive discussion.

Cases under examination through the procedure of simplified proceedings, court decisions on applying simplified proceedings, the actions of participants of the case upon receipt of the decision, the procedure and time limits for examining the case through simplified proceedings and other issues were touched upon during the professional discussion.
