Process of transferring function of Register of the Ministry of Justice to advocates will be reformed and will contribute to investments

Today, on April 29, under the chairmanship of Deputy Minister of Justice Grigor Minasyan and Secretary General of the Ministry of Justice Sirvard Gevorgyan, a meeting-discussion was held with representatives of law firms during which the specialists of the Agency for State Register of Legal Entities presented the procedure and conditions for advocates or law firms to perform the functions of the service office of the Agency for State Register of Legal Entities.

According to the decision of the Government, the functions of the service office of the Agency for State Register of Legal Entities can also be performed by the law firms and advocates who have had taxable turnover of at least AMD 30 million per year for the past 2 years and have been operating for at least the past 5 years.

After concluding the relevant contract, the advocate or the employee of the law firm takes training courses and receives a login and password in order to secure access to the information system. During the meeting, Deputy Minister Minasyan noted that in spite of the training courses being held, nevertheless, in the course of works in the future, there are such cases to be entered in the system that, when filling in the information about those cases,, those performing the functions of operators face difficulties, and in order to resolve them, the heads of information technologies or the co-ordination department of the territorial service offices of the Agency are contacted. Accordingly, attaching importance to ongoing process of delegating as a manifestation of the public-private partnership and pursuing the goal of promoting investments, the meeting was organised on the initiative of the Ministry of Justice, the purpose of which is:

-       to recall the information received during the training course for law firms that are already performing the functions of a service office,

-       to present other persons the procedure for performing the functions of a service office, as well as the procedure for entering applications for the most frequently requested services.

In the first part of the meeting, the Agency for State Register of Legal Entities briefly presented the e-register information system, the procedure for concluding a contract for implementation of the functions of the service office, as well as the sequential steps for implementation of the most frequently provided services and the fields to be filled in. In the second part of the meeting, a question-and-answer session was held during which representatives of the advocatorial community attending the meeting raised a number of practical issues, some of which were resolved on the spot by consensus, and some of which were inventoried for inclusion in the agenda of the Ministry. The advocates suggested that, after delegating the functions of service offices, the operators are provided with the opportunity to have several users, and, in this regard, Deputy Minister Minasyan highlighted that the option of envisaging such an opportunity with lower fees will be considered in the nearest future. It was noted that the issue will be considered in the context of the process of digitalisation and that the contracting company will be given the opportunity to register several operators. The Deputy Minister highlighted that, in this way, thanks to digital technology solutions, a number of practical risks will be prevented.
