Reforms in compulsory enforcement sector will contribute to efficiency and effectiveness of conduct of enforcement actions: a package of drafts submitted to Parliament

Two draft legislative acts on making amendments and supplements to the Law “On compulsory enforcement of judicial acts” targeted at the ongoing implementation of reforms in the compulsory enforcement sector, were considered in the second reading in the National Assembly.

The draft proposes to define an option for other compulsory enforcement officer to carry out a specific enforcement action within the scope of the enforcement proceedings (without transfer of the enforcement proceedings), as well as mechanisms for joining enforcement proceedings in one set of proceedings or separating them.

The proposed regulations will contribute to the increase of efficiency and effectiveness of performance of enforcement actions, create an opportunity to engage additional human resources, reduce the workload of enforcement officers and have a positive impact from the perspective of saving financial resources.

The other draft has regulated and specified the relations arising in case of necessity to deposit property when performing enforcement actions, the cases of maintaining the property at the expense by means of the Compulsory Enforcement Service, as well as envisaged — in case the deposited property was not claimed — a possibility to realise it as prescribed by the Law “On public biddings” or through direct sale and return the received amount to the debtor (owner of the property).
