Powers of director of SNCO terminated, disciplinary proceedings instituted against 12 notaries, disciplinary penalty imposed on 31 compulsory enforcement officers — final report of 2022

The working group of the Control Department of the Ministry of Justice headed by Deputy Head of Department Artashes Suchyan, gathering the complaints of the citizens, as well identifying other deficiencies, consistently continues to fight against the non-bona fide servants  and defective phenomena detected within the subdivisions of the Ministry through the measures provided for within the scope of disciplinary proceedings.

As a result of the disciplinary proceedings instituted against 12 notaries, disciplinary liability measures, i.e. 5 warnings, 2 reprimands, 1 severe reprimand and 3 suspensions of activity — for a month under two cases and for two months under one case, respectively — were imposed. Within the scope of disciplinary proceedings, one notary resigned from the job based on the application submitted.

One disciplinary proceedings against bankruptcy administrator was carried out, as a result of which a disciplinary liability measure, i.e. reprimand was imposed.

Drafts of 4 decisions on removing a bankruptcy administrator from record-registration, 2 decisions on suspending the activity of a bankruptcy administrator and 1 decision on terminating the activity of a bankruptcy administrator, were drawn up.

Based on the results of official investigations assigned on the basis of instructions given according to the results of studies conducted under the annual action plan of the Control Department of the Compulsory Enforcement Service, disciplinary penalties were imposed on 31 compulsory enforcement officers, including 22 warnings, 8 reprimands and 1 strict warning. In accordance with the applications submitted within the scope of official investigation, 3 compulsory enforcement officers were dismissed from office.

Based on the results of a study of applications and complaints, the Service has received letters asking the Service to provide clarification and express appropriate stances; as a result, disciplinary penalty — warning and reprimand — has been imposed on 3 compulsory enforcement officers.

Based on the results of studies conducted by the Department, the powers of the director of the "National Archives" SNCO have been terminated.

With regard to employees of the Ministry of Justice, 4 official investigations have been conducted, official investigation has been terminated under 3 cases, disciplinary penalty — warning — has been imposed under 1 case.

The Control Department has conducted 2 studies in the penitentiary and probation sectors, and based on the results, 2 instructions have been given to the respective institutions.

There have been 4 official investigations, as a result of which disciplinary penalty has been imposed on 3 officers of the Penitentiary Service and of the Probation Service.

With regard to the Agency for State Registration of Legal Entities, 11 administrative proceedings have been instituted, in 2 cases — the appeal was rejected, in 2 cases — the appeal was partially upheld, in 2 cases — the appeal was fully upheld, in 1 case — the proceedings were suspended, in 1 case — the proceedings were dismissed, and administrative proceedings instituted under 3 cases are ongoing.

Based on the results of official investigations conducted with respect to the processes of civil status acts registration, disciplinary penalty has been imposed in 4 cases — 1 reprimand, 3 warnings.
