Arush Arushanyan to be deprived of liberty — Court grants motion of Probation Service

Head of Goris community Arush Arushanyan will be imprisoned for a term of 1 year and 8 months. The Court of General Jurisdiction of Syunik Marz granted the motion of the Probation Service of the Ministry of Justice. Let us remind that by Criminal Judgement No SD/0043/01/21 of the Court of First Instance of General Jurisdiction of Syunik Marz of 28 March 2022, Arush Arushanyan was convicted and sentenced to imprisonment for a term of 6 months and 18 days under part 1 of Article 308 of the Criminal Code of the Republic of Armenia (adopted in 2003) and for a set of crimes, a fine in the amount of 700-fold of the minimum salary wage and deprivation of the right to hold senior positions in local self-government bodies for a term of 5 years. Punishment in the form of imprisonment imposed on Arush Arushanyan was not applied conditionally, and probation period of 1 year and 6 months was assigned as prescribed by Article 70 of the Criminal Code. Beneficiary Arush Arushanyan, being deprived of the right to hold senior positions in local self-government bodies assigned under a judicial act as punishment, and being informed of the disciplinary liability prescribed by law in case of failure to fulfil the punishment requirement, continues to hold the position of head of Goris Municipality of Syunik Marz. A protocol on the avoidance of punishment has been drawn up by the Territorial Body of the Service of Syunik Marz (according to part 1 of Article 34 of the Penitentiary Code of the Republic of Armenia, "in case of avoidance by the convicted of execution of the decision on depriving him or her of the right to hold certain positions or engage in a certain activity, the Probation Service shall draw up a protocol thereon and file a motion on replacing the punishment imposed on the convict with imprisonment with the Court"), and a motion has been filed with the Court of First Instance of Syunik Marz of the Republic of Armenia to replace the punishment of deprivation of the right to hold a senior position in local self-government bodies imposed on Arush Arushanyan under the criminal judgement with deprivation of liberty, as well as on abolition of the decision on conditional non-application of punishment in the form of deprivation of liberty and sending to serve the sentence.
