New Law “On enforcement proceedings” has abolished the outdated institution of writ of execution — Deputy Minister

Deputy Minister of Justice Levon Balyan delivered an opening speech at the three-day "Training for Trainers" event devoted to the new Law "On enforcement proceedings". The event was attended by judges, as well as representatives of the public and private sectors, who will go on to conduct sector-specific trainings on implementation of the Law. The Deputy Minister mentioned that the new Law "On enforcement proceedings," which provides for complete, comprehensive regulations related to compulsory enforcement and contains a number of principled innovations, will enter into force on July 1, 2025. Setting aside certain provisions of the Law, he stressed that a new system for calculating enforcement costs has been introduced, along with a new mechanism under which, upon mutual consent of the parties, it is possible to defer or postpone fulfilment of an obligation. He reminded that the aforementioned was only possible through a separate court decision, which required that citizens make additional expenses and spend extra time. Touching upon the reform of the Law, Levon Balyan mentioned that, in certain cases, upon enforcement of the Law, a citizen in proceedings will have the opportunity to manage attached property, that is to say, deliver it for lease or sell it independently and out of auction, by paying the rent and price of sale to the deposit account of the Compulsory Enforcement Service. He informed the participants that the outdated institution of writ of execution is renounced under the new Law. "Implementation of the new Law will provide the opportunity to ensure new quality of compulsory enforcement, introduce predictable and clear regulations, and enhance the efficiency of enforcement,” the Deputy Minister concluded. The event was organised by the Project "Support to the effective execution of the judgments of the European Court of Human Rights in Armenia", which is being implemented within the scope of the Council of Europe Action Plan for Armenia for 2023-2026 and is funded by the Human Rights Trust Fund.
