As of January 2023, the 26th statement of claim on civil forfeiture of property of illegal origin is accepted for proceedings at the Anti-Corruption Court. What is done in the framework of anti-corruption reforms?

For the purpose of establishing mechanisms aimed at civil forfeiture of property of illegal origin, yet on 16 April 2020, the National Assembly adopted the Law "On civil forfeiture of property of illegal origin" and the laws on making amendments and supplements to related laws.

The Law regulates the relations pertaining to proceedings for civil forfeiture of property of illegal origin, defines the grounds for starting examination, the scope of bodies authorised for initiating proceedings for civil forfeiture of property of illegal origin and conducting an examination, as well as regulates other relations pertaining to civil forfeiture of property of illegal origin.

The property is considered of illegal origin, if it is not substantiated by legal revenues, irrespective of the circumstance whether it has been obtained before or after the Law "On civil forfeiture of property of illegal origin" entered into force.

The process of civil forfeiture of property of illegal origin is implemented under civil-procedural proceedings.

For the purposes of launching the institute of civil forfeiture of property of illegal origin, on 3 September 2020, a subdivision in-charge — the Department for cases of civil forfeiture of property of illegal origin — was established under the General Prosecutor's Office of the Republic of Armenia..

In 2022, totally 75 materials regarding the ownership of property of possible illegal origin by 84 persons were received at the Department for civil forfeiture of property of illegal origin of the General Prosecutor's Office and 77 decisions were made on starting examination with regard to them, and 2 examinations were initiated based on the data obtained in the framework of proceeding on civil forfeiture of property of illegal origin.

At the same time, it should be noted that as of January 2023, the 26th statement of claim on civil forfeiture of property of illegal origin was accepted for proceedings at the Anti-Corruption Court.

In order to ensure high level of professional preparedness of the Department for cases of civil forfeiture of property of illegal origin, the prosecutors of the mentioned Department regularly undergo trainings organised both by local and international experts.
