Recommended to pay monthly increment to prosecutors; Levon Balyan presents the drafts at the sitting of the National Assembly

At the National Assembly, Deputy Minister of Justice Levon Balyan presented the issue of adopting in the second reading the package of draft laws on making supplements to the Criminal Procedure Code of the Republic of Armenia and on making amendments and supplements to the Law “On the Prosecutor's Office".

Levon Balyan stated that establishment of a prosecutors' group, regulation of relations and powers of the Head of the group and member prosecutors, the review of categorisation of prosecutors’ positions as per the framework of powers, are among the key changes.

Under the drafts, it is recommended to clarify the requirements for a person contending to be included in the list of candidates for prosecutors; it is also recommended to remove the provision related to criminal prosecution not being implemented on non-acquitting ground from the list of restrictions on being appointed as a prosecutor and the grounds for dismissing from position.

The Deputy Minister also stated that it is suggested to solve the issue of comprehensive exercise of the power to protect state interest in exceptional cases and in the manner reserved to the Prosecutor's Office by the Constitution.

The Deputy Minister of Justice also presented the draft laws on making amendments and supplements to the Law "On Remuneration of persons holding state positions and state service positions", as a result of which monthly increment would be paid to the prosecutors in the amount of ninety-two percent of position rate.

Levon Balyan stated that such attitude was put forward taking into account certain important factors, such as the incomparably high probability of existing external pressures on the prosecutor during the criminal proceedings, conditioned by the circumstance that the prosecutor is granted with exclusive power of making both favourable and unfavourable decisions for a person during the proceedings.

According to the Deputy Minister, in the conditions of increments to be provided to the prosecutors, it is envisaged to implement attestation in the system by the end of 2024.
