6-month process of the institution of issuing by a notary public of an executive order under the claim for levying a sum, possible legislative solutions: Three-stage discussion with participation of notaries public and judges kicks off

At the initiative of the Ministry of Justice, a discussion was organised in an unprecedented format and was devoted to the solution of issues recorded within the scope of the 6-month internship for introducing the institution of issuing by notaries public of an executive order under the claim for levying a sum.

Advisor to the Minister of Justice Liana Tovmasyan welcomed the participants of the discussion, noting that, in the case of other actions being carried out within the scope of judicial-legal reforms and in the case of legislative amendment for introduction of the institution of issuing by notaries public of an executive order under the claim of levying a sum, the Ministry of Justice is consistent with identifying and resolving the legal and practical issues that emerge within the scope of law-enforcement practices established following the implemented reforms, and this modality is aimed at ensuring continuity and sustainability of the implemented reforms.

Liana Tovmasyan expressed gratitude to the Supreme Judicial Council and the judges attending the event for the efforts that they have made to introduce the institution and for the ongoing support aimed at implementing the legislative amendments, as well as emphasised the willingness of the Notarial Chamber and the notaries public for the functioning and betterment of the newly introduced institution.

Judge of the Civil Court of Appeal Ani Mkhitaryan, Deputy Chairperson of the Board of the Notarial Chamber of the Republic of Armenia Anahit Ghazaryan and National Programme Manager of the Council of Europe Project "Support to Judicial Reforms in Armenia" Arman Zrvandyan also delivered opening remarks at the event, and representatives of the Central Bank and the Compulsory Enforcement Service participated in the event as well.

A number of issues on guarantees, penalties, notices, time limits and calculations — recorded in the first six months of application by notaries public of the institution of issuing an executive order under the claim for levying a sum, and the mechanisms for solutions and the potential legislative solutions were recorded. Discussions will be held in three stages, aiming to provide training for all notaries public of the Republic of Armenia.

The event was organised within the scope of the CoE Project "Support to Judicial Reforms in Armenia", which is co-funded by the EU and the CoE under the "Partnership for Good Governance" initiative.
