Acceptance of an clearly unfounded statement of claim to be rejected immediately — Another draft law reducing workload of courts submitted to the National Assembly

Deputy Minister of Justice Armenuhi Harutyunyan has submitted to the Chairperson of the Standing Committee on State and Legal Affairs of the National Assembly the package of draft Laws "On making amendments and supplements to the Law "On state duty"" and "On making amendments and supplements to the Civil Procedure Code”.

As a result of the proposed amendments, the possibility of freezing multimillion transactions by paying the current state duty of AMD 20.000 in the event of a claim for the invalidity of contracts arising from entrepreneurial activity or corporate legal relations will be reviewed, as, in this case, a duty in the amount of 3% of the contract price will be charged. The definitions of clearly unfounded claims will be clarified, and the court will have the opportunity to reject statements of claim with such claims immediately, without even having to accept them for proceedings and rendering an expedited judgement on rejection.

It is proposed to eliminate preferential regulation for paying minimum state duty provided for simplified proceedings. The incremental duties in respect of all administrative acts posing monetary obligations shall be equalled and specified in order to rule out the possibility of different interpretations by courts.

The Standing Committee on State and Legal Affairs gave a positive opinion on the draft Law; it will be considered during the plenary session of the Parliament.
