Transportation procedures for supervision over persons convicted in a foreign country or Armenia, transfer of convicts — Armenuhi Harutyunyan presents draft in the National Assembly

Deputy Minister of Justice Armenuhi Harutyunyan presented the draft Law "On legal assistance in criminal proceedings" to the Standing Committee on State and Legal Affairs of the National Assembly; the draft Law received a positive opinion from the superior committee. For the first time in the legislation of the Republic of Armenia, this Draft provides an opportunity to comprehensively regulate international co-operation in criminal proceedings between states.
The Draft consists of 10 chapters, by which the procedures for extradition, transfer of convicts, transfer under supervision over persons convicted or persons with conditional early released from punishment in the territory of a foreign state or of the Republic of Armenia, as well as legal relations pertaining to the recognition (transformation) of court judgements of foreign states and international courts and the consequences of those judgments have become a subject of separate regulation.
The adoption of the Law "On legal assistance in criminal proceedings" derives from the Action Plan of the Government of the Republic of Armenia and is aimed at regulating a wide range of relations pertaining to matters of providing legal assistance provided for by ratified international treaties, as well as in the absence of international treaties, including the conduct of procedural actions and actions of proving; handover of documents and items; exchange of information; taking testimonies or explanations from persons; providing information about detained persons or other persons; inspecting, searching, receiving and transferring physical or digital evidence; conducting expert examinations; summoning as a witness, victim, property defendant, their legal representative or lawyer; engaging an expert in the Republic of Armenia and performing procedural actions; transferring persons deprived of liberty as witnesses or participants in a confrontation, documents, as well as digital data, records required for the disclosure of a criminal case; using criminally acquired items, tools and means of crime used or intended for use in the commission of a crime; in case of their absence, attachment on equivalent property, distribution, transfer of confiscated property, including temporary transfer; transfer of criminal proceedings; transfer of convicts; supervision over a person with conditional release from punishment; recognition of a court judgment imposed by a court of a foreign state or an international court.
